Means any products, items, documents, or packages.
1-6-1 Fragile Goods
Means any goods that are inherently fragile, or have fragile components, that require special packaging and/or handling to ensure they are not damaged and such goods include, but are not limited to, electrical goods, glass, China, ceramics, pottery, and crockery. fossils, artifacts, artwork, or similar articles or merchandise.
1-6-2 DANGEROUS GOOD 
 All shipments must be legal products, and not contain any dangerous goods. 
This includes but is not limited to:
A. Illegal drugs and/or any other illegal substances.
B. Explosives and/or fireworks, flammable materials.
C. live animals.
D. Firearms, weapons, ammunition, or associated parts.
E. Biological and/or chemical materials and hazardous materials.
F. Compressed oxygen or other gases.
G. Flammable liquids including alcohol and flammable solids, such as nitrocellulose.
H. Infectious substances.
I. Oxidizing substances, such as ammonium dichromate or pool chlorine.
J. Radioactive materials.
K. Other goods that are not permitted by the applicable law to be sold or transported within the country.
We reserve the right to refuse any shipping It contains these goods.

QUEENDELIVERYThe company provides courier services through three service levels:
1. Royal Account: for companies and pharmacies that require delivery services managed by it QUEENDELIVERY Team.
2. King Account: For companies and pharmacies that choose to manage deliveries through Private drivers
3. Master Account: 
Users may be natural or legal persons. In order to access our website, all users are required to register a personal profile. When registering, we may ask you, for the following information, but is not limited to.
The name, mobile phone number, and address, credit card information, email address, information about the geographical location issued by the user’s device, and other information about the user that may contribute to the verification process or provide the service.
1-9-1 The Service is available for use by persons at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18).
1-9-2 You agree to maintain the security and secrecy of your Account username and password at all times and not disclose it to anyone.
1-9-3 All account information is provided for use of the named account holder only, and not for any other person.
1-9-4 You are responsible for all activity that occurs under your Account, and any consequences of unauthorized access to your account.
1-9-5 We reserve the right to cancel or reject the account at any time without notice.

This includes but is not limited to shall not be liable for any liability ,claim ,loss ,injury ,or damage of any kind resulting in any way from any errors in or omissions from our Website; the unavailability or interruption of our Website or any delay or failure in performance of our Website.
3- Intellectual Property Ownership    
The websit , mobile app and its original content, features and functionality are owned by Queen delivery inc  .
 and are protected by international copyright, trademark, trade secret, patent and other intellectual property or proprietary rights laws.
The Company name, the Company logo, our trademarks in the form of words, graphics, and logos and the product names associated with the Software and Service are trademarks of the Company  and no right or license is granted to use them.

You must not:

B- Sell, rent or sub-license material from QUEENDELIVERYy

4- Representations and Warranties 
4-1 You will not use the Service or Software to cause nuisance, annoyance or inconvenience.
4-2 You will only use the Service or Software for lawful purposes; you will not use the Services for sending or storing any  for fraudulent purposesor unlawful material
4-3 You will not try to harm the Software or Service  in any way whatsoever.

Working hours are the times in which shipments are received and delivered according to the specified and announced dates Our site works 24/7, however, we are not responsible for the unavailability of the service at any time and we will do our best to continue the service on our site.
We reserve the right to suspend access to our website, whether total or partial.

7- Terms and conditions that apply to the Royal account :-
7-1 SERVICES
Royal Account: for companies and pharmacies that require delivery services managed by it QUEENDELIVERY Team 
QUEENDELIVERY offers express door-to-door delivery during GTA or areas west of Toronto, we deliver on the same day of receiving the shipment,
provided that it is received at the specified times
For areas east of Toronto, we deliver the next day of receiving the shipment, provided that it is received at the specified times.     
QUEENDELIVERY company provides service cash on delivery (COD) the company's drivers collect amounts from the receiver and the company keeps the amounts and delivers them to the sender on the next visit. 
7-2 Driver:
QUEENDELIVERY contracts with the driver to pick up and deliver shipments.
The driver does not work for the company but works as an independent contractor.
The company is not responsible for him, and our responsibility to the driver and the customer is limited to receiving and delivering shipments.
7-3 Packaging and label:
7-3-1 The shipment must be packed properly. Customer bears sole responsibility for any damage or loss arising from poor packaging and labeling of its belongings.
7-3-2 QUEENDELIVERY is not liable for any damage or loss arising from shipments that contain extra-fragile items for example, and not as a limitation Glass of all kinds, porcelain of all kinds, liquid supplies, mirrors, laptops, and mobile, However, the Customer allows arranging deliveries for such items but understand that they do so at their own risk. If the Customer decides to take this responsibility, we recommend using shatterproof materials, proper labeling and provide accurate details of shipment. Claims for such cases will be declined by QUEENDELIVERY.
7-3-3  As for the pharmacy, all shipments sent to one address (even if it is to more than one person) must be placed in a big bag and one label should be placed.
7-3-4 For the pharmacy, the refrigerator medicines should be placed in a separate bag from the rest of the medicines, with the explanation in the notes box. in the form on the website.
7-4 REFUSAL OF SERVICE
QUEENDELIVERY reserve the right to refuse any package from you for the following reasons without liability to deliver the shipment on time.
This includes but is not limited to:
7-4-1 For any illegal content which is strictly prohibited such as Illegal drugs. Explosives and Firearms.
7-4-2 If any violation of federal, provincial law, or for fraudulent purposes.
7-4-3 A package having incomplete information.
7-4-4 The package contains dangerous goods.
7-4-5 Products that are improperly packaging or labeling. 
7-4-6 Unpaid packages.
7-4-7 Any shipment or merchandise that does not meet our standard dimensions or weight permitted as specified in our Standard Operating Procedures or that otherwise requires special equipment or labor resources in excess of one person to be loaded into or unloaded from our vehicles.
7-5 Undeliverable shipments
1. If the shipment is, or we consider it, unacceptable goods.
2. If the receiver cannot be reasonably identified or located.
3. If the receiver refuses to receive the shipment.
7-6 INSPECTION
You agree that QUEENDELIVERY without any notice, at any time for any reason may, at our sole discretion, If we deem the shipment may be in opposition to stated Terms and Conditions that we may open any package or shipment to check the content of the shipment and ensure that it does not contain any unacceptable goods, and maintain the right to contact the proper authorities.
7-7 Payment
7-7-1 Fees and expenses for services are calculated with reference to the terms and prices mentioned in the agreement.
7-7-2 The price is shown on the website (excluding HST tax of 13%) .
7-7-3 We offer one invoice services which you will get bi-week.  and you agree to pay for the invoice in full within the applicable time period.
7-7-4 You are required to bring any dispute that you may have with regard to billing to QUEENDELIVERY 's attention no later than (15) days after billing occurs.
7-7-5 After this period has passed, you will be deemed to have irrevocably accepted all such bills
7-7-6 The customer is able to see the instant prices based on the distance, weight, and volume entered in the field on the QUEENDELIVERY website.
7-7-7 QUEENDELIVERY reserves the right to change the prices of the services at any time we deem necessary without prior notice.
7-7-8 You will always be primarily responsible for all delivery services charges. You will also be responsible for any costs we may incur in either returning your shipment to you or warehousing it pending disposition.
7-7-9 You must give us notice of any change to your name, e-mail address, or other circumstances that may affect the payment of any fees at least 15 days prior to the date of the change.
7-8 Limitation of Liability  Royal account
7-8-1 We will not be liable for any loss, delay, or damage, whether direct, indirect, or secondary, including but not limited to loss of -profit or income, which may in any way occur as a result of a delivery error, non-delivery, or delay in delivery.
7-8-2 We will not be liable for loss, damage, or delay caused by events we cannot reasonably foresee or control which may expose employees and drivers to risks, including but not limited to acts of God, riots, and civil commotion. Risks, weather conditions, war, and defects inherent in goods (such as dangerous or fragile goods) or goods deemed unacceptable, lack of proper packaging or lack of labeling, and if the consignee refuses to take delivery of the shipment.
7-8-3 Without prior written consent, the compensation value for any insured shipment cannot exceed $50.
7-8-4 Submit a claim
We will not be liable for loss, delay, or damage to any packages unless notice specifying shipment details (sender, recipient, shipment number) is given 15 days after your shipment date.
7-8-5  indemnification
You shall indemnify and hold us harmless from all liabilities, losses, claims, damages, expenses, and costs of any kind which we may incur as a result of our carriage of your shipment or your failure to comply with any regulation. Which you should note in connection with the transportation of shipped goods.
7-8-6 We will not be liable for loss, damage, delay, or damage as a result of your use of our website or your inability to access our website for any reason.

3-8-10 At its sole discretion, the QUEENDELIVERY may suspend or terminate your account to the system or the Service, for any reason, with or without notice to you and without liability to you , your team or your customer
8- subscription 
8-1 When you purchase a Subscription  you expressly authorize us (or our third-party payment processor) to charge you for such Subscription. We may ask you to supply additional Payment Information relevant to your Subscription, including your credit card number, the expiration date of your credit card and your email and postal addresses for billing and notification.
8-2 When you initiate a Subscription You represent and warrant that you have the legal right to use all payment method(s) represented by any such Payment Information. , 
8-3 you authorize us to provide your Payment Information to third parties so we can complete your Transaction and to charge your payment method for the type of Transaction you have selected plus taxes and other charges.
8-4 Fees and expenses for services are calculated with reference to the terms and prices mentioned in the agreement.
8-5 The price (excluding HST tax of 13%) shown on the website is in Canadian dollars. 
8-6 Customers can add credit cards (Visa, MasterCard, American Express) and debit cards. During checkout, the customer gets a payment confirmation message to the email address registered in his file. 
8-7 One card will be always set as a default card by the system.
8-8 It is your responsibility to ensure that your credit card has a  sufficient balance to carry the costs of your purchase and renewly  Subscription.
8-9 We offer one invoice services which you will get every 30 days.  and you agree to pay for the invoice in full within the applicable time period.    
8-10 You are required to bring any dispute that you may have with regard to billing to QUEENDELIVERY 's attention no later than (15) days after billing occurs.       
8-11 After this period has passed,  you will be deemed to have irrevocably accepted all such bills.
8-12 The customer can view the prices according to the plan he chooses through the QUEENDELIVERY website
8-13 QUEENDELIVERY reserves the right to change the prices of the services at any time we deem necessary without prior  notice.   
8-14 You must give us notice of any change to your name, e-mail address, or other circumstances that may affect the payment of any fees at least 15 days prior to the date of the change.   
8-15 we or our third-party payment processor will automatically charge  beginning of each month , using the Payment Information you have provided until you cancel your Subscription. 
8-16 When you purchase a Subscription ou acknowledge that your Subscription has recurring payment features and you accept responsibility for all recurring payment obligations prior to cancellation of your Subscription by you queen delivery inc. 
8-17your purchase a Subscription is final and you will not be able to cancel the purchase or receive a refund but you may cancel your Subscription at any time, but please note that such cancellation will be effective at the end of the then-current Subscription period
8-18 If you cancel, your right to use the Services will continue until the end of your then current subscription period and will then terminate without further charges.
9- Information Use
You  agree to receive SMS Text messages, email and mobile notifications when certain events occurs such as when your prescription is ready or when a new prespription refill is created.
If you no longer wish to share your information with Queen Delivery, or if you would like to delete your account and all your data, please contact support at support@queendelivery.ca
10- Cookies
We employ the use of cookies. By accessing Queen Delivery, you agreed to use cookies in agreement with the Queen Delivery's Privacy Policy.
Most interactive websites use cookies to let us retrieve the user’s details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website
11- Termination
At its sole discretion,We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you without liability to you or any third party. 
All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions,limitations of liability ,indemnity , and warranty disclaimers .
You may terminate this agreement at any time by ceasing all use of the software or services.
12- Dispute Resolution 
10-1 The parties shall first attempt to resolve any dispute related to this Agreement in an amicable manner by mediation with a mutually acceptable mediato.
10-2 This Agreement (polices ,further rules , or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Ontairo , Canada, without giving effect to any principles of conflicts of law.




              We may change this Terms of Use from time to time without prior notice.  The revised terms and conditions will become effective upon posting and if you use the Service after that date, we will treat your use as acceptance of the revised terms and conditions. If any change to this Terms of Use is not acceptable to you, your only remedy is to stop accessing and using the Service.
